Age Verification Cookies Act

I have a website that needs to be done with alcohol, which needs to check the age before allowing them to get to the website. I do this using the HttpModule, which validates the cookie, and if it is not set, I redirect them to the verification page. I check their age and store a cookie containing a boolean to make sure they have been verified or not.

How does this fit into the cookie law since I cannot find such examples?

Do I still have to agree to a cookie or an exception of this kind?

I did a search, I can’t find anything that responds to such things.

There is an exception to the requirement to provide cookie information and consent if the use of a cookie:

(a) for the sole purpose of transmitting a message over an electronic communications network; or

(b) when such storage or access is strictly necessary to provide the services of the information society requested by the subscriber or user.

I think your case falls under (b), but this, of course, is open to interpretation.
