IPhone: Can I take samples from the garage range and use them in my application?

Question

Not really a programming issue, but here it goes.

Say, for example, I am creating an iPhone drum app. (don’t worry, I’m not making a drum app, the path to many of them already!)

Would it be normal for drum sounds to directly record drum sounds from the garage range and use them as drum sounds in an application?

Or - is there any legal agreement stopping this? It's okay to compose songs with garage range instruments, so what's normal to do instrument instruments?
