Intelligent Program Criteria

Question

Just out of curiosity, suggesting that there is a life form of software. How do you find it? What are your criteria for determining whether something / someone is smart or not?

It seems to me that creating such software is quite simple as soon as you set the right goal (and not just on the naive "facial human-test").

When sending a response, try also to find a counter example. I really find it difficult to come up with something consistent with which I myself agree.
