Does Scenic Ribbon require MS licensing?

The new Scenic Ribbon is now part of the Windows API (Office 2007 Free Tape wasn’t).

Does anyone know if a program using Scenic Ribbon should go through a licensing process, such as a program that uses the Free Ribbon option?

Waht - is it if the program does not use the original Windows API, but a third-party toolkit that imitates the "Scenic Ribbon" layout? - Will it be a special case for licensing?
