\ Windows \ versus \ Windows \ System32 - File Location Agreements

Is there a standard convention for file types that go to \ Windows \ versus those that go to \ Windows \ System32 ??

I am working on an SDK that has many exe helpers dlls and windows exe services. The previous guy who worked on the code put two exe files in \ Windows \ and a DLL in \ Windows \ System32 \ But it seems to me that they will probably all be in \ Windows \ System32 \

What would you do?

Edit: I am NOT trying to discuss virtues if they go there at all. Many applications install things on System32 ... especially for services or drivers (both of which I mean). Of course, I am not saying this correctly ... as I said, I did not create it initially ... for the sake of this question. If this was your only choice ... what happens?

Edit: OK, the point is made. I really did not think that I could convince the "architect" of this project to remove them from any of these two directories ... but now I will try harder. Agreed ... nothing should be placed in these folders.
